Program Participation and Website Terms and Conditions

 

Health Care Service Corporation (“HCSC”) and its foodservice provider, Compass Group North America ("Compass"), (collectively "We", or "Us") use a third-party supplier, Systopia to provide you with this program and Website.  We require that you, a Customer of Compass participating in this program, agree to the following participation Terms and Conditions.  If you do not agree to the Terms and Conditions, you must immediately discontinue your use of the program. By enrolling in this program and setting up a user name and password, you acknowledge and accept of these Terms and Conditions. We may, at any time and at our sole discretion, change these terms by updating this posting. We shall not be required to provide you with prior or written notice of any change to these terms, your continued participation in the program and use of the Website shall constitute your acceptance of any change to these terms.

Website Content. You acknowledge that the Website contains information, data, software (whether applications, scripts, plug-ins or applets), photographs, graphics, text, images and other material (collectively, the "Content") that are protected, individually and collectively, by copyright, trademark, patent or other proprietary rights of the Company, Compass, or the Supplier. You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part, except as expressly allowed by this Terms of Use and Privacy Statement or applicable law (including, without limitation, U.S. copyright, trademark and patent law). Concerning certain designated Content, you may make a single copy of the Content, provided that the copy is made only for your personal, informational and non-commercial use and that you do not alter or modify the Content in any way. You must not delete or alter any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Except as provided above, you may not upload, post, reproduce, modify or distribute in any way the Content without obtaining permission of the owner of the copyright or other proprietary right. Your access and use of the Website in accordance with this Terms of Use and Privacy Statement does not give you any right or interest in any Content or other information available on the Website, which at all times shall remain the property of the Company or other owner.

Conformance with Law. Your access to and use of the Software and this Website is subject to all applicable laws and regulations.

Intellectual Property; Content; Reserved Rights. The trademarks, logos and service marks ("Marks") displayed in the Software and on this Website are the respective properties of the Company, Supplier or Compass. In the absence of express prior written consent of the Company, Supplier or Compass, you may not use any Marks for any purpose, including without limitation, as metatags on other web Websites or web pages. All information contained in or displayed by the Software or the Website, including without limitation, any software available on or through the Website ("Content") is protected by copyright. Without the express prior written consent of the Company, Supplier or Compass (or other owner of the copyright for the Content), no one is permitted to copy, modify, download, screen-scrape, distribute, transmit, display, publish, sell, license, use or create a derivative work with respect to, any Content.  The Company, Supplier, Compass, and all other owners of any intellectual property in or on, or available through the Software or the Website, reserve all rights to such intellectual property to the extent not expressly granted.  

Hyperlinks. If this Website contains links to other web Websites, neither the Company nor Compass are responsible for the content or other information contained in such linked Websites, and disclaim any responsibility for the accuracy or appropriateness of such content or information.

No Representation or Warranty.  We make no representation or warranty as to the availability, accuracy or completeness of the content of the Software or the Website, and shall not be liable for any damages or injury resulting from user access to or inability to access the Software or the Website or from reliance on any information in either. The Software and the Website may contain information about products that may or may not be available in any particular country or region of the world may be available under different trademarks in different countries and, where applicable, may be approved or cleared by a government regulatory body for sale or use with different indications and restrictions in different countries. Nothing contained on this Website should be construed as a promotion or solicitation of an offer for any product or service that is not authorized by the laws and regulations of the country where you are located, or whose laws may be applicable.

Waiver of Class Actions. You the Customer waive, to the fullest extent allowed by law, any right you may have to pursue any claims on a class or consolidated basis or in a representative capacity.

Governing Law.  Supplier, on our behalf, maintains the Website from various locations. We make no representation that the Content in the Website is appropriate or available for use in any jurisdiction, and access to them from locations in which such Content is illegal is prohibited. Those who may choose to access the Website from other jurisdictions do so at their own initiative and are responsible for compliance with applicable local laws.  Any claim relating to the Website or the Content and all transactions related to the use of this Website shall be governed by the laws of the State of California and applicable federal law, without regard to conflict of laws principles, and all users of the Software and the Website consent to venue and jurisdiction in the courts of said State for the enforcement of these Terms of Use.

Age Restrictions. You may only use the Software and this Website if you are age 18 or older.

Good2Go Cashless Program. For Customers that participate in this program, the Good2Go cashless system is a closed-loop, prepaid payment system that provides a convenient alternative to paying with cash or credit card in the HCSC cafes. You fund your Good2Go account with a specific dollar value. This dollar value is a pre-payment for purchases in your cafes that accept Good2Go. Your HCSC employee ID badge is the credential for your account, and your ID badge is required in order to access your account in the cafes.   Your Good2Go account does not         accrue interest, dividends or any other earnings on funds deposited to your account. The value of your account is not insured by the Federal Deposit Insurance Corporation (FDIC).

  • We reserve the right to not accept a Good2Go account or limit use of a Good2Go account if we reasonably believe that the use is unauthorized, fraudulent or otherwise unlawful.
  • You can fund your account with a dollar value using a credit card or cash by visiting your local café, or by using this Website. Minimum and maximum funding values may be enforced. All amounts loaded and maintained on your Good2Go account are denominated in U.S. dollars.
  • For your convenience, you can take advantage of the Good2Go account auto-recharge feature. You establish auto-recharge on this Website, by linking a credit card to your Good2Go account and establishing a trigger threshold and a recharge amount. Your credit card will be charged for the recharge amount upon initial setup, and then automatically whenever your trigger threshold is met.  An automated e-mail will be sent after each auto-recharge purchase to notify you of the account activity. You may change your auto-recharge preferences at any time by visiting this Website. You may cancel the auto-reload feature at any time by visiting this Website.   You must cancel the auto-reload feature if you leave the employ of HCSC.
  • There are no fees associated with the use of the Good2Go account system.
  • Your Good2Go password that you select should have at least eight characters and include both alphabetic and numeric data.
  • Treat your HCSC employee ID badge like cash. Because you utilize your ID badge like cash, you are responsible for all transactions associated with your badge, including unauthorized transactions. If you have questions regarding your transaction history or account accuracy, please contact your local Compass management. We shall have no liability for transaction discrepancies unless you provide us notice within sixty (60) days of the date of the transaction in question. If your badge is lost or stolen, please notify your local Compass management immediately, so that we can freeze the remaining balance on your account. Once you have been issued a replacement badge by HCSC, the remaining account balance will automatically be accessible by using the replacement badge.  Neither HCSC nor Compass are responsible for lost or stolen ID badges or any transactions that occur on a lost or stolen badge.
  • Your account and membership may be terminated upon your termination of employment with HCSC. Upon any event of termination of your account and membership, a refund will be issued to you for unused balances in your account; provided, however, that unused funding issued to your account by Compass as a result of special promotions or rewards will not be refunded to you. You must cancel your auto-recharge, if applicable, before requesting a refund.
  • You may view, change or delete information about you in your Good2Go account by logging into Website and following the instructions. You are solely responsible for maintaining the confidentiality of your personal account and password and for restricting access to your computer and personal account, and you accept full responsibility for all activities that occur under your personal account or password. Compass reserves the right to terminate your personal account at any time and for any or no reason.

Loyalty & Rewards Programs. As a Customer, you are also eligible to participate in various Loyalty & Rewards programs (the “Rewards Programs”) that may be offered from time to time.  As a member of the Rewards Programs, you are eligible to earn credits ("Credits") for your qualifying purchases at participating cafes. You may redeem your Credits for rewards that Compass establishes from time-to-time ("Rewards"). Compass has sole discretion to determine the number of Credits you earn for a purchase, which purchases qualify for Credits, and the number of Credits required for a Reward. No purchase is necessary to enroll as a member of the Rewards Program. However, Credits are only earned when you make a qualifying purchase at a participating café. To earn Credits for a purchase, you must present your HCSC employee ID badge at the time of sale. Credits and/or Rewards cannot be transferred, purchased, sold or traded. Credits earned cannot be pooled or shared. Credits cannot be earned on purchases made before joining the Rewards Programs or on the purchase of gift cards or charitable items. Credits are not redeemable for cash.

  • Membership in the Rewards Programs is limited to residents of the United States. Corporations, groups and other entities are not eligible to become members or to earn Credits or Rewards. Compass reserves the right to void Credits and Rewards to any person(s) who have wrongfully earned Credits via deception, forgery or other abuses of the Rewards Programs.
  • Compass may, at its sole discretion, alter, limit or modify the Rewards Programs rules, including the Credit earning structure, Rewards, Reward levels or any other feature of the Rewards Program, at any time without notice.
  • Compass may terminate the Rewards Programs at any time at its sole discretion without notice. Compass may terminate your membership in the Rewards Programs at any time at its sole discretion without notice. You may terminate your membership in the Rewards Programs by contacting your local Compass café management.
  • Financial Disclaimers. Your Rewards Programs balance does not accrue interest, dividends or any other earnings on Credits in your account. The value of your Rewards account is not insured by the Federal Deposit Insurance Corporation (FDIC). We are not responsible for lost or stolen HCSC employee ID badges or any transactions that occur on a lost or stolen badge. Your account and membership in the Rewards Programs may be terminated upon your termination of employment with HCSC. All Credits remaining in your Rewards account upon termination of your account or membership may be forfeited.

 

Privacy Policy

This Privacy Policy applies to you as a Customer of Compass and to your use of this Website and software. It describes how information is collected and used, how it is protected and what options you have in connection with this information.  By participating in this program and using this Website and software, you agree to the collection and use practices described in this Privacy Policy. This policy may be modified from time to time. We reserve the right to modify the terms of the policy at any time, effective upon updating this posting.

What Information is Collected. In order to use the program "Personally Identifiable Information" is collected; this is information that can be used to identify you as an individual, such as your name, email address, and HCSC employee ID badge number.

How is Information Used.  The information that is collected is only used by Compass to complete the processing of your order, the processing of payments and to provide you with reports and summaries of purchases you have made. Compass may also use your information for its own internal business, marketing and promotional analysis. These activities may be outsources to third parties but only if they agree to comply with the terms of this Privacy Policy. Your Personally Identifiable Information is not sold or released to any other person unless:

  • The Customer consents to such sale or disclosure;
  • It is required by law or in response to lawful subpoena or court order;
  • It is required to enforce our collection rights or defend property of ours, of our Compass, or of Customers of Compass; or
  • If Compass believes in good faith that disclosure without delay is required to reduce the risk of death or grave personal injury.

Cookies. Cookies are small text files that a web server can create and place on a user`s computer when not prevented by preference settings in the users browser. A cookie does not read content or information on the user’s computer, but the server originally placing it can subsequently retrieve the contents of the cookie itself, including information on other Websites.  Compass may use session cookies to enhance navigation within our Website during the session of your visit to the Website, but these cookies do not survive the end of your visit, and thus provide us no information about other Websites between visits to this  Website. You may adjust your remote browser not to accept cookies but in some cases the Software or Website may function less effectively or deny access to you.

Security. Whereas perfect security is not achievable, we have conducted a risk assessment process, and have implemented security precautions commensurate with that risk, to protect the Personally-Identifiable Information about you from unauthorized access or misuse. We have implemented an industry-standard secure Website, using Secure Socket Layers (SSL) to construct a secure pipe between your browser and our Website. The password you use to access your personal information is stored in Compass’ Website in industry-standard hashed format to reduce the risk of compromise through external hacking.

Legal Notice of mySYSTOPIA Mobile Application and Good2Go website

mySYSTOPIA Mobile application and Good2Go website (hereinafter, the “Applications”) are products developed by Systopia Consulting Ltd a company of Zucchetti Group.

By using the Applications, You declare that you understand and acknowledge the following legal information concerning the Applications (and the elements contained therein). If you are not in agreement with these conditions, you should not use the Applications. We may revise this Legal Notice at any time by updating this posting. Your continued or subsequent use of the Applications after such revisions have been made will constitute your acceptance of such revised Legal Notice.

Definitions

The terms:

  • “Client”: refers to a client of the Company that has entered into a contract with the Company for the Applications in order to allow its customer (including You) to interact with the Client’s foodservice operation;
  • “Systopia”, “Company”, "We", “Us” refers to the entity of our business, including Systopia Consulting Ltd and any of its affiliates and subsidiaries of the Zucchetti Group;
  • “You” refers to natural person that is a customer of the Client.

Purpose

The Applications are provided by Systopia as a service to a Client who provides food operations and wants to allow its customers to:

  • order food from the Client’s foodservice locations and make payment online to the Client;
  • maintain a cashless payment account for use at the Client’s foodservice locations;
  • view purchase history and retrieve payment receipts;
  • track loyalty program usage related to Client’s loyalty programs.

The Client is the entity that provides the foodservice operation and that directly receives all payments made online by its customer through the Applications. Systopia has no control over the services provided by such Client, hence You are requested to refer to the Client’s terms of use and its privacy policy when using the Applications.

Copyrights and other property rights

You acknowledge that the Applications contain information, data, software, photographs, graphics, text, images and other material (collectively, the "Content") that are protected, individually and collectively, by copyright, trademark, patent or other proprietary rights of the Company or third parties. Your access and use of the Applications in accordance with this Legal Notice does not give You any right or interest in any Content or other information available on the Applications, which at all times shall remain the property of the Company or other owner.

Applications Content

The Applications contain information of the Client related to its services and products. Systopia hereby disclaims any representations and warranties regarding the content or accuracy of such information and the quality of the Client’s services and products.

Services and Products provided by the Client

Even if involved in creating, producing or delivering of the Applications for the Client, Systopia disclaims all warranties, express or implied, in connection with the services provided by the Client through the Applications and shall not be liable in any manner whatsoever for any direct, incidental, consequential, indirect or punitive damages arising out of Your access to the Applications and use of the Client’s services and products.

Registration and Personal Data

In order to use the Applications, You are required to register an account with the Client. By using the Applications, you acknowledge that the Client is the data controller over your personal data and for data privacy purposes Systopia is acting only as the Data Processor, as requested by its Client.
